the service
adbtd provides email infrastructure services, including the provisioning of mailboxes, the allocation of dedicated outbound IP addresses, and the operation of the underlying SMTP, IMAP, DNS, and reputation-warmup mechanisms required for the proper functioning of those mailboxes. We are responsible for the operation, monitoring, and maintenance of the underlying servers. You remain at all times the holder of the account, and the mailboxes provisioned under your workspace remain under your exclusive control and responsibility.
your account
- You represent and warrant that you are at least eighteen (18) years of age and that you possess the legal capacity to enter into a binding contract.
- You are solely responsible for the confidentiality of your account credentials and for all activity carried out through your account, whether by yourself or by any third party to whom you have granted access.
- As a general principle, a single workspace is intended to correspond to a single legal entity. The creation of additional workspaces by the same entity is permitted, provided that such creation is not used to circumvent applicable limits or to dissociate the workspace from its prior reputation history.
- The information that you provide upon registration must be accurate, complete, and current. You undertake to update such information promptly should any of it change.
acceptable use
Email is, by its very nature, a shared resource, and any abuse of that resource is liable to cause harm to all users of a given IP range. Accordingly, you undertake not to use the service for any of the following purposes:
- to send unsolicited bulk email (commonly referred to as “spam”), nor to purchase, scrape, rent, or otherwise acquire recipient lists obtained without the prior consent of the persons concerned;
- to send phishing communications, malware, fraudulent solicitations, harassing or unlawful content, or any communication of a nature that you would be unwilling to defend publicly;
- to relay messages through our infrastructure on behalf of any third party without our prior written consent;
- to attempt to circumvent applicable rate limits, reputation safeguards, or per-mailbox sending caps;
- to probe, scan, reverse-engineer, or load-test the service without having first agreed the scope and conditions of such activity with us;
- to operate any mail flow that contravenes the laws applicable to you, to your recipients, or to the French Republic.
We monitor bounce rates, complaint rates, and external blocklist activity on a continuous basis. Should the activity of your workspace exceed acceptable thresholds, we reserve the right to suspend outbound delivery and to contact you to investigate the cause. Repeated or serious breaches of the present clause shall constitute grounds for the termination of the account.
pricing and billing
Each mailbox is invoiced at a unit price of 1.99 per month, and each dedicated IP address at a unit price of 19 per month, expressed in the currency selected by the customer at the time of the first checkout (United States dollars, euros, or pounds sterling, the same nominal value being applied across all three currencies). Each workspace is operated on a minimum of one dedicated IP address, and we do not provide any shared sending pool. Invoices are issued on a monthly basis through our payment processor, Stripe, and any applicable value-added tax or sales tax is calculated and collected by Stripe Tax in accordance with the law of your jurisdiction.
You may cancel your subscription at any time. Cancellation shall take effect at the end of the current billing cycle and shall not give rise to any refund of amounts already paid in respect of that cycle. Where the number of mailboxes or dedicated IP addresses is reduced during a billing cycle, the unused portion shall be credited against the subsequent invoice rather than refunded to the original means of payment. Should a payment fail, we shall undertake automatic retries and shall notify you accordingly; in the event that the outstanding amount remains unpaid, outbound sending capability may be suspended until the account is brought current.
We reserve the right to revise our prices for new orders at any time. In the event of a price revision affecting a plan to which you are already subscribed, we shall notify you by electronic mail no less than thirty (30) days prior to the entry into force of the new price, and you shall be entitled to terminate the subscription before that date should you not wish to accept the revised price.
your content
You retain full ownership of all electronic mail processed through the service. We do not claim, and shall not assert, any rights over the content of messages, message headers, contact lists, or attachments. Such data is processed solely for the purposes of delivering, securing, and operating the service. The detailed conditions of such processing are set out in our privacy policy.
service availability
We strive to maintain a high level of service availability and treat any operational incident with the seriousness it deserves; however, we do not, at this stage, publish a contractual service level agreement supported by financial credits. The current availability target is therefore expressed on a best-efforts basis, accompanied by transparent post-incident communications. Scheduled maintenance windows shall be communicated to account holders in advance whenever practicable.
termination
You may terminate your account at any time by addressing a written request to koren@pukogames.com. We reserve the right to suspend or terminate any account that is in breach of the present terms, that is the subject of abusive use, that has unpaid invoices, or that is operated in a manner that places other tenants of the service at risk. Upon termination of an account, the mailboxes and any associated data shall be deleted; you are accordingly invited to export any content that you wish to preserve prior to closure. Invoices shall be retained for the period required by French tax law.
warranty and liability
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with the service shall be limited to the total amount actually paid by the customer to adbtd during the twelve (12) months preceding the event giving rise to the claim. Under no circumstances shall we be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, loss of reputation, or the deliverability decisions of any third party that lie outside our reasonable control.
Nothing in the present terms shall be construed as excluding or limiting any liability which cannot lawfully be excluded or limited under French law, including liability for fraud or for personal injury caused by negligence.
governing law and jurisdiction
The present terms shall be governed by, and construed in accordance with, French law. Any dispute arising out of or in connection with the present terms or the service shall be submitted to the exclusive jurisdiction of the competent courts of France. Where the customer qualifies as a consumer, the present clause shall be without prejudice to the protections afforded by the mandatory consumer-protection law of the customer’s country of habitual residence.
amendments
We reserve the right to amend the present terms from time to time. Where any amendment materially affects the rights of the customer, account holders shall be notified by electronic mail no less than thirty (30) days prior to its entry into force, and the customer shall be entitled to terminate the subscription before that date should the amendment not be acceptable. Continued use of the service following the effective date of an amendment shall constitute acceptance of the amended terms.
